THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 5890 of 2015 Date of Judgment: 9.3.2015 Between:

T. Sudheshna and another

...Petitioners

And The Secretary, Board of Intermediate, State of Telangana and another ..Respondents THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 5890 of 2015 ORDER:

Heard learned counsel for the parties.

The petitioners 1 and 2 are intermediate second year students of Sri Gayatri Junior College, Chaitanyapuri, Dilsuknagar, Hyderabad.

It is stated that they paid examination for intermediate second year course to be held from 10th March, 2015, but by mistake the fee was

not remitted by the college, as a result their hall tickets were not issued. The present writ petition is filed seeking a direction to the respondents 1 and 2 to issue hall tickets and permit them to appear for the said examinations. Mr. Abhishek Reddy, learned standing counsel for the respondents 1 and 2 states that last date for receiving the examination fee and issuing of hall tickets has long back expired and since the examinations are scheduled to be held from 10th March, 2015, now it is not possible for the respondents to receive the examination fee and issue hall tickets.

In view of the said submission and as the petitioners have approached this Court at the last minute, discretion cannot be exercised and the writ petition is liable to dismissed.

However, the learned counsel for the petitioners has submitted that after these examinations, there would be advance supplementary examinations to be conducted in May, 2015 and results would be declared in June, 2015 and if the petitioners are permitted to appear for the said examinations, they may not loose academic year. In the circumstances, the petitioners are at liberty to appear for the said advance supplementary examinations.

With the liberty as above, the writ petition is

dismissed along with miscellaneous applications, if any. No order as to costs.
