THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3076 OF 2016 ORDER:
This petition is filed by the petitioner-accused No.1 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.625 of 2015 on the file of the II Additional Judicial First Class Magistrate, Bhimavaram, West Godavari District. Heard and perused the material available on record. It is alleged that while L.W.2- brother of the 2nd respondent was doing private job, A2 approached him and informed that he knew one advocate-A1, who got contacts with the High Court Judges and he will provide an employment in the High Court. L.W.2 informed the same to the 2nd respondent. Then, the 2nd respondent and the father-in-law of L.W.2 met A2 and A2 took them to the house of A1 and introduced A1 to the 2nd respondent. A1 asked L.W.1 to give 10 lakhs to provide job to L.W.2.
A1 told to open an account in an Axis Bank branch and remit the amount partly into his account. Accordingly, the 2nd respondent remitted Rs.2 lakhs to the account of A1 on 19.10.2011, Rs.4 lakhs on 9.11.2011 and Rs.4 lakhs on 8.12.2011. A2 collected Rs.2 lakhs from the 2nd respondent. After four months, as there is no response from A1, L.W.1 asked A1 over telephone and questioned him about job of L.W.2 and the accused postponed the issue on one pretext or the other and later, the accused gave arrogant replies.
Thus, the accused committed the offence punishable under Sections 420, 506 and 406 r/w 34 IPC.
Considering the facts and circumstances of the case and the contents in the charge sheet, this Court is not inclined to grant the relief sought by the petitioner.
At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner
before the trial Court is dispensed with except on the dates when his presence is specifically insisted by the trial Court. The petitioner shall be represented by a Counsel before the trial Court on all hearing dates.
Accordingly, the Criminal Petition is disposed of.
