Endla Komaraiah v. The Chairman And Managing Director, Singareni Collieries
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.32105 of 2017 ORDER:
This writ petition is filed to declare the action of the respondents in not referring the petitioner's case to the Corporate Medical Board of the respondents company as illegal and arbitrary. Sri J.Sreenivasa Rao, learned Standing Counsel appearing for the respondents says that the petitioner has to make representation to the General Manager, Srirampur Area, where the petitioner is working, but not respondent No.1, to whom the petitioner has made representation. He further submits that unless the representation is made to the competent authority, no action can be taken.
Learned counsel for the petitioner submits that the petitioner will make necessary application to the concerned authority. In view of the same, without expressing any opinion on merits, the writ petition is disposed of granting liberty to the petitioner to make representation to the competent authority and on filing such representation, the competent authority shall dispose of the same in accordance with Rules and Regulations of the respondent-Company. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
