Heard learned counsel for petitioners and Sri R.Radhakrishna Reddy, learned standing counsel representing the third respondent.
2. The petitioners pray for mandamus, declaring the action of respondents in interfering with or dispossessing the petitioners from the property bearing Municipal No.8-1-293/A/33, admeasuring 227 sq.yards at Dwaraka Nagar Colony, Shaikpet, Hyderabad, without recourse to law as illegal and unconstitutional.
3. The case of petitioners briefly referred to is that steps taken by third respondent for negotiated settlement and acquisition of a portion of petitioners land were not successful. In respect of neighbouring properties, the second respondent passed award determining the compensation payable for the acquisition of property covered by neighbouring owners and the demolition of the acquired properties is underway. The apprehension voiced by the petitioner is that without acquisition or negotiations demolition of a portion of petitioners property is taken over the petitioners will be put to great loss and hardships.
4. Sri R.Radhakrishna Reddy on instructions submits that the prayer as on date is without a cause of action and based on mere apprehensions. The learned standing counsel submits that if a portion of the premises bearing Municipal No. 8-1-293/A/33 is required for road widening, the third respondent will follow the procedure stipulated by law. Compensation paid and thereafter the petitioners will be dispossessed from acquired land. The statement of learned standing counsel is placed on record and the writ petition is accordingly disposed of. No order as to costs.
3. As a sequel, Miscellaneous Petitions if any, pending in this writ petition shall stand closed.
