The present writ petition is filed by the petitioners under Article 226 of the Constitution of India, seeking a direction to the 2nd respondent to grant stay of the order dated 15.9.2016 passed by the 3rd respondent in Case No.LTR/31/2012/BPD, Case No.LTR/31/1/2012/13PD. 2.
Heard and perused the material available on record. 3.
It is stated in the affidavit that the 1st petitioner is the husband of the 2nd petitioner. The 2nd petitioner is the owner of the land admeasuring Ac.2.07 guntas in S.No.195 of Sarapaka Village, Burgampahad Mandal, Bhadradri Kothagudem District. While so, the 4th respondent filed a case before the 3rd respondent against the petitioners for eviction from the said land. The 3rd respondent passed orders on 15.9.2016 in the above case observing that the petitioners herein are liable to be evicted. Aggrieved by the same, the petitioners preferred an appeal before the 2nd respondent on 10.10.2016 along with an application seeking to stay the order of the 3rd respondent. But the 2nd respondent has not passed any orders so far. 4.
Considering the facts and circumstances of the case and the grievance of the petitioners, the Writ Petition is disposed of with the following direction:
"The 2nd respondent is directed to dispose of the appeal filed by the petitioners as expeditiously as possible. Till disposal of the appeal, the order challenged before the 2nd respondent in the appeal, is suspended. However, it is made clear that this order
does not stand in the way of the 2nd respondent to pass appropriate orders in the appeal in accordance with law." No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
