This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.605 of 2025 of Film Nagar
Police Station, Hyderabad District, registered for the offence punishable under Section 69 of the BNS.

The brief facts of the case are that, on 29.09.2025, the de-facto complainant lodged a report before the police stating that she acquainted with the petitioner in the year 2019 and she met with him physically in the year 2020 and he promised her that he would marry her and under the promise of marriage, the petitioner exploited her physically and in the month of April, 2025, when she asked him for marriage, the petitioner refused to marry her. Hence, she requested for necessary action. Basing on the said complaint, the police registered a case for the above said offence.

Heard Sri K. Srinivas Reddy, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner herein is innocent of the said allegations and he is falsely implicated in this case and the de-facto complainant herself blackmailed the petitioner under the guise of relationship between them and whatever, the relationship between the parties is a consensual relationship, as both are majors. It is further submitted that, even according to the de-facto complainant, from the year 2020, they are in relation and there is no such allegation against the petitioner to constitute the offence punishable under Section 69 of the BNS and the custodial interrogation of the petitioner is not required in this case and he is ready to cooperate with the investigating authority. Learned counsel for the petitioner relied on the Judgment of the Hon'ble Supreme Court in the case of Surendra Khawse vs. State of Madhya Pradesh and another and also the order passed by this Court in Crl.P.No.3950 of 2025 dated 26.03.2025 and prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by learned counsel for petitioner stating that the allegations against the petitioner are serious in nature. It is further submitted that, under the guise of marriage, the petitioner exploited her physically and therefore, he is not entitled for anticipatory bail and prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, even according to the de-facto complainant, they are in relation from the year 2020 and the petitioner herein, under the promise of marriage, exploited her physically. Though, she has not requested for marriage, the petitioner herein refused to marry her. Considering the facts and circumstances of the case and the consensual relationship between the parties and also the averments made by the learned counsel for the petitioner, this Court deems it fit to grant pre-arrest bail to the petitioner/accused, subject to the following conditions:
i.
The petitioner/accused shall surrender before the Station House Officer, Film Nagar Police Station, Hyderabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- each, with two sureties, for the like sum each.
ii.
The petitioner/accused shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case.
iii.
The petitioner/accused shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the
filing of the charge sheet and thereafter, as and when required 7.
Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
