This petition is filed under Section 439(1)(b) of Cr.P.C. to relax the conditions imposed by the Special Judge for Andhra Pradesh Protection of Depositors of Financial Establishments Act-cum-Principal District and Sessions Judge, West Godavari at Eluru in Crl.M.P.No.468 of 2016 in Crime No.3 of 2015 of Pedapadu Police Station, West Godavari District, whereby the Sessions Judge by order dated 12.05.2016 while enlarging the petitioners - Avva Venkata Rama Rao and Avva Venkata Seshu Narayana Rao @ Kumar, on bail, directed them to furnish security for Rs.5,00,000/- with two sureties.
Now the petitioners seeking relaxation of the said condition on various grounds mainly on the ground that similar order was passed in Crl.P.No.2002 of 2017 by this Court directing the petitioner therein to execute bond for Rs.3,00,000/-. But the petitioner therein is a different person. The petitioner therein was not main accused in that petition and therefore, on that ground this Court relaxed condition and directed the petitioner to execute bond for Rs.3,00,000/-. The petitioners herein are not entitled to relaxation of the said condition for enlargement on bail, as the petitioners herein have committed serious offences and that the total amount involved in this case is in crores of rupees. Therefore, I find that it is not a fit case to relax the
condition by exercising power under Section 439(1)(b) of Cr.P.C.
Accordingly, the criminal petition is dismissed. Pending miscellaneous petitions in the petition, if any, shall stand closed.
