HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.39500 of 2015 ORDER :
Petitioner in this Writ Petition assails the action of 3rd respondent in seizing the stocks viz., Raw Bengal gram and Bengal gram etc. by conducting panchanama dt.21-09-2015 at the petitioner's shop on the ground that he had stored huge quantity of stock, that he had not maintained the accounts in the prescribed manner, that variations were found and there was contravention of the provisions of Andhra Pradesh Scheduled Commodities Dealers (Licensing, Storage and Regulation) Order, 2008.
2. The counsel for petitioner states that the petitioner is willing to furnish a bank guarantee for the value of seized stocks and on that condition, seized stocks be released to the petitioner. 3.
The Government Pleader for Civil Supplies appearing for respondents states the respondents have no objection for release of the seized stocks of green gram subject to the petitioner furnishing a bank guarantee for their value.

Therefore, this Writ Petition is disposed of directing the respondents to release the seized stocks to the petitioner on condition of the petitioner submitting a bank guarantee for their value as assessed by 3rd respondent and subject to the petitioner keeping the said bank guarantee alive during the pendency of the proceedings under Section 6A of the Essential Commodities Act, 1955. There shall no order as to costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
