ORDER:

Non-issue of Occupancy Certificate by respondent No.2 in respect of the building situated in Plot Nos.59 and 60 of A.G's Office Co-Operative Housing Society, Gudimalkapur, Hyderabad, is assailed in this Writ Petition by the owners of Plot No.130, Satyanarayananagar, Gudimalkapur, Hyderabad.

At the hearing, Mr. N.Ashok Kumar, learned Standing Counsel for the Greater Hyderabad Municipal Corporation, appearing for respondent Nos.2 and 3, on instructions, submitted that on 27.01.2016, the office of

respondent No.2 has sent a communication to respondent No.4, who is the developer of the abovementioned building, for compliance with certain requirements including payment of Rs.3,85,200/-. He has further submitted that if and when the said requirements are complied with, respondent No.2 will issue Occupancy Certificate.

Mr. N.Subba Rao, learned counsel representing Mr. M.Koteswara Rao, learned counsel for the petitioners, submitted that his clients will ensure that the requirements stipulated in the abovementioned communication will be complied with. In view of the above facts, respondent No.2 is directed to issue Occupancy Certificate in respect of the above-mentioned building within two weeks of compliance with the requirements mentioned in the communication, dated 27.01.2016, sent by him to respondent No.4. Subject to the above direction, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.3211 of 2016 shall stand disposed of as infructuous.
