THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.24915 of 2015 ORDER :

Heard learned counsel for petitioner and Sri Pasham Krishna Reddy, learned standing counsel for respondent GHMC and with their consent, the writ petition is taken up for disposal at the admission stage.

2. This writ petition is filed questioning the action of the respondents and in not taking action on the complaint/representation given by the petitioner dated 11.06.2015 regarding illegal constructions made by 3rd respondent by encroaching upon the public lane and also blocking the way, as illegal.

3. Petitioner claim that he is a resident of 16-4-428/A, Chanchalguda, Hyderabad and that there is a public lane on the eastern side of his house and the residents of that locality are using the said lane for several years. He further claims that the 3rd respondent started construction of house without any building permission and by encroaching upon the public road due to which the way was completely blocked. The 3rd respondent has also no valid title documents. He further claims that the 3rd respondent has raised a wall over the property of the petitioner by laying a beam without his consent and inspite of his protest. The petitioner gave a complaint to the 2nd respondent on 11.06.2015 alleging illegal constructions made by the 3rd respondent, however no action is taken thereon and the same is pending. Since no action is being taken by the officials of

respondent corporation, the present writ petition is filed.

4. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to the respondents 1 and 2 to expeditiously dispose of the above representation.

5. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the respondents 1 and 2 to consider the complaint/representation of the petitioner dated 11.06.2015, and pass appropriate orders as warranted under law within a period of four weeks from the date of receipt of copy of this order and communicate the decision to the petitioner. The respondents 1 and 2 are directed to put the 3rd respondent on notice and afford due opportunity, before the orders are passed.

No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
