HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19889 of 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India challenging the action of the respondents in laying CC road through the land of the petitioner, without issuing any notice to her and without following the due process of law.

It is the case of the petitioner that she is the owner of the lands admeasuring Ac.0.33 and Ac.0.32 cents in Sy.Nos.896-1A and 896-2 situated at Markapur Town, Prakasam District. While so, the respondents highhandedly made markings through her land, without following the due process of law. Hence, the petitioner filed this writ petition.

Heard and perused the material available on record. The main grievance of the petitioner is that the respondents are trying to interfere with her land, without following the due process of law.

Considering the circumstances of the case and the grievance of the petitioner, this Court is inclined to pass the following order: " The respondents are directed to follow the due process of law, if they intend to acquire the land of the petitioner." Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
