ORDER:

The case of the petitioners is that the father of the first petitioner was a partner in M/s. Viraj Constructions. M/s. Viraj Constructions owns Ac. 3.27 guntas of land in Survey Nos.28/1, 28/2 and 28/3, corresponding to TSLR No.21, Ward No.94, Block 'G', situated at Begumpet, Hyderabad. There appears to be a series of litigation on the said property. The present writ petition is necessitated on account of the alleged illegal constructions taken up by respondents 3 to 6 even though the property do not belong to them and the property actually vested in the custody of the Advocate Commissioner appointed by the Court on 01.01.2003. Ventilating their grievance against such illegal construction, the petitioners and others filed a representation on 25.06.2015 addressed to the Commissioner, Greater Hyderabad Municipal Corporation, Tank Bund, Hyderabad (1st respondent).

Alleging that the said representation is not acted upon and no orders are passed and on the other hand, the party respondents are proceeding to undertake construction, this writ petition is filed.

Since the representation is already submitted, which is pending consideration of the 1st respondent Municipal Corporation, the Writ Petition is disposed of, without expressing any opinion on merits, granting liberty to the petitioners to mark a copy of the representation submitted to the 1st respondent

Municipal Corporation on 25.06.2015 to the Deputy Commissioner, North Zone, Greater Hyderabad Municipal Corporation, Secunderabad (2nd respondent) within a period of one (1) week from today and as and when such a representation is received by the Deputy Commissioner, he shall consider the same, shall cause notice on respondents 3 to 6, give due opportunity of hearing to the petitioners as well as respondents 3 to 6 and pass appropriate orders, as warranted by law, on the grievance agitated by the petitioners. The entire exercise shall be completed within a period of six (6) weeks from the date of receipt of representation. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
