HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.9210 of 2015 ORDER:
This Criminal Petition is filed Under Section 482 Cr.P.C. by the Petitioners-A1 to A5 to quash the proceedings initiated against them in Crime No.282 of 2015 of Gajwel Police Station, Medak District, registered for the offences punishable under Sections 498-A I.P.C. and Sections 3 and 4 of Dowry Prohibition Act. A private complaint was filed by the 2nd respondent herein against the petitioners for the aforesaid offences before the Judicial Magistrate of First Class, Gajwel, Medak District and it was referred to the police under Section 156 (3) Cr.P.C. for investigation and report. Thereafter, the Sub Inspector of Police, Gajwel Police Station registered the complaint as a case in Crime No.282 of 2015 against the accused for the aforesaid offences and took up investigation.
Heard the learned Counsel appearing for the petitioners and the learned Public Prosecutor, representing the State. The allegations in the complaint prima facie reveal the commission of alleged offences by the petitioners herein. The matter has to be investigated by the police so that the truth or otherwise of the allegations can be brought out. Therefore, I see no grounds to interfere with the investigation of the case at this stage. Accordingly, the Criminal Petition is dismissed. However, the Investigating Officer is directed to proceed with the investigation expeditiously, however, the petitioners-A1 to A5 shall not be arrested without following the procedure as contemplated under Section 41A Cr.P.C.
Miscellaneous petitions, if any, pending shall stand closed. _________________
