HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 33443 of 2012 Order:

This writ petition was filed challenging the action of the first respondent in opening rowdy sheet in the name of the petitioner in Wyra Police Station, Khammam District, pursuant to the direction of the respondents 2 and 3.

2. The first respondent filed a counter affidavit stating that the petitioner was involved in two criminal cases and in one of the criminal cases he was acquitted and trial is going on in another case i.e., SC No.436 of 2013, which is posted to 12.02.2016. He further stated that though a rowdy sheet was opened in the year 2011 and extended till 2013, as per the instructions of the then Superintendent of Police, the rowdy sheet was closed on 11.02.2013.

3. In view of closure of rowdy sheet against the petitioner, nothing survives for adjudication in the writ petition and the matter has become infructuous.

4. Accordingly, the Writ Petition is dismissed as infructuous. However, in the circumstances, no costs.

5. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
