HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 27327 of 2017 ORDER:

The inaction of respondent No.2, in investigating into FIR.No.31 of 2016, is questioned in this Writ Petition as being illegal and arbitrary.

Learned Government Pleader for Home (TS) would place before this Court the written instructions from the SubInspector of Police, Banjara Hills Police Station, Hyderabad, wherein it is stated that, after completion of investigation, a final report, under Section 173 of the Criminal Procedure Code, 1973 (Cr.P.C), was filed in the Court of III Additional Chief Metropolitan Magistrate, Nampally at Hyderabad on 16.01.2017 vide SR.No.190 of 2017, and notice to the complainant was also sent by registered post on 05.01.2017. Since the final report has been filed, the cause in the Writ Petition does not survive necessitating adjudication by this Court. Leaving it open to the petitioner to avail his remedies under the Cr.P.C., the Writ Petition is dismissed. Miscellaneous Petition pending, if any, shall also stand dismissed.
