THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34867 of 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the respondents 3 and 4 in calling the petitioners to the police station and insisting them to pay the amounts without registering any crime at the instance of the fifth respondent as illegal and arbitrary and consequently direct the respondents 3 and 4 not to harass and threaten the petitioners. Heard and perused the material.

Learned counsel for the petitioners submits that respondents 3 and 4 are calling the petitioners very frequently to the police station and abusing and threatening them by detaining them for hours together. He further submits that on an earlier occasion, the petitioners got an order directing the respondents 3 and 4 not to indulge in such activities and that in spite of the said direction, the respondents 3 and 4 are continuing the said activities. Hence, he prays this Court to direct respondents 3 and 4 not to harass the petitioners. Learned Assistant Government Pleader for Home (Telangana) submits that respondents 3 and 4 are not interfering with the affairs of the petitioners at any point of time.

Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to respondents 3 and 4 not to interfere with the disputes between the petitioners and the fifth respondent and not to harass the petitioners by calling them to the police station or in any other way. It is made clear that if the respondents 3 and 4 are continuing such activities even after this order, the petitioners are at liberty to lodge a complaint against respondents

3 and 4 to the second respondent, who is superior officer to the respondents 3 and 4, and the second respondent is also directed to consider the representation of the petitioners, if any such application is filed by the petitioners aggrieved over the high handed action of the respondents 3 and 4 and take action in accordance with law.
