HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.13430 OF 2017 ORDER:

The petitioner preferred this Writ Petition against the respondents viz; the Principal Secretary, Agriculture & Cooperation Department, the Commissioner of Cooperation and Registrar of Cooperative Societies, Telangana State, The Joint Registrar of Cooperative Societies and the Karimnagar Cooperative Urban Bank Limited.

The prayer in this writ petition which reads as follows:- " To issue a writ or mandamus or any other appropriate writ or writs, order or direction, declaring the action of the Respondents in not conducting Elections to the Managing Committee of the 4th respondent Bank before the expiry of the term of the Managing Committee of the 4th respondent Society by duly following the provisions of the Telangana Cooperative Societies Act, 1964 and the Rules made thereunder as being illegal, unjust and contrary to law and consequently direct to the respondents to conduct elections to the Managing Committee of the 4th respondent forthwith and pass such other order or orders, as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

Heard the learned counsel for the petitioner and the learned Govt. Pleader for Cooperative Societies for the respondents, and perused the writ petition prayer, supporting affidavit and other material on record.

The lis in this writ petition is squarely covered by the Common order, dt.21.06.2017 in W.P.Nos.4665 and 10421 of 2017, particularly in W.P.No.4665 of 2017 passed by this Court and same is not disputed by the learned Government Pleader for Cooperative Societies.

Having regard to the above, this writ petition is allowed in terms of the Common order in W.P.Nos.4665 and 10421 of 2017, dt.26.06.2017 particularly in W.P.No.4665 of 2017 with the following directions:- The respondents are directed to forthwith commence the process for appointment of Election Officer and secure all the records from the Ex-Managing Committee and finalize the eligible list of Members entitled to vote and contest and therefrom after other formalities required seek for the dates for nominations and scrutiny and finalization in conducting of elections, counting and declaration and the process shall be conducted at any cost within six (06) weeks from the date of receipt of a copy of this order. Registry is directed to append a copy of the common order in W.P.Nos.4665 and 10421 of 2017, dt.26.06.2017 to this order. Consequently, miscellaneous petitions, if any shall stand closed.
