P. Adimurthy v. The District Collector,
THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No. 24563 of 2012 ORDER:
The petitioner substantially complains against the inaction or tacit support of Respondents 1 and 2 to the acts of commissions or omissions of Respondents 4 to 8, as illegal and arbitrary. 2.
To appreciate the matter, this Court finds it useful to reproduce the prayer in the writ petition, which reads as follows: " ... to issue writ of mandamus declaring the action of the Respondents 1 and 2 in supporting the unofficial Respondents 4 to 8 for construction of Seetharamula Mandapam in Gram Panchayath Bhavan above Community Hall in Chennampalli village, Bukkarayasamudram Mandal, Anantapur district as illegal, arbitrary and in violation of principles of natural justice and consequently direct the Respondents not to construct Seetharamula Mandapam above Communiuty Hall in Chennampally Gram Panchayath, Bukkarayasamudram Mandal, Anantapur District."
3.
On 08.08.2012 this Court granted interim order restraining Respondents 4 to 8 from making further construction for a period of two weeks, and on 10.09.2012, the said interim direction was extended until further orders.
4.
The 3rd Respondent filed counter affidavit, and it is stated by way of reply that the construction has been stopped by Respondents 4 to 8.
5.
As the prayer is substantially worked out, the learned counsel for the petitioner submits that no further order is necessary, having regard to the stand taken in the writ petition. 6.
The statement is placed on record, and the writ petition is disposed of accordingly. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
