THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18099 of 2016 ORDER:

Heard the learned counsel for the petitioner and Smt.K.Lalitha, learned Standing Counsel for R-5.

As seen from the affidavit averments of the petitioner, petitioner is the tenant of 5th respondent-Temple and cultivating its land in Rs.No.69/1 for an extent of Acs.2.83 cents at Vaddiparru Village, Atreyapuram Mandal, East Godavari District. The limited grievance of the petitioner in this writ petition is that there is a standing crop in the said land and the respondent authorities may be directed to allow the petitioner to harvest the standing crop. Petitioner further prays that he also may be permitted to participate in the public auction proposed to be conducted on 09.06.2016 for leasehold rights for the subject land for the period from 2016-2017.

Learned Standing Counsel Smt.K.Lalitha appearing for first respondent, on instructions, submits that the petitioner would be allowed to harvest the crop and petitioner being eligible to participate in the auction, he is also entitled to participate and offer his highest bid, if he desires, to cultivate the land pursuant to the auction notification. In view of the submissions of the learned Standing counsel, the grievance of the petitioner stands redressed and no further orders need be passed in this writ petition by this Court. As the auction is scheduled today, Smt.K.Lalitha, learned Standing counsel for R-5, undertakes to inform the respondent authorities to ensure participation of the petitioner in the auction. Accordingly, the Writ Petition is disposed of. No order as to costs.

Consequently, miscellaneous petitions pending in the writ petition, if any, shall stand closed.
