THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4124 of 2017 ORDER:
Notice issued under Section 402 of the Hyderabad Municipal Corporation Act, 1955 against the petitioner, directing him to remove the alleged encroachments within three days from the date of receipt of the notice, is challenged before this Court. In terms of the impugned Notice the petitioner alleged to have encroached on the public road.
Heard.
Having considered the learned counsel for the petitioner and the learned standing counsel for GHMC, notice granting of three days time being unreasonable, without expressing any opinion, the Writ Petition is being disposed of giving liberty to the petitioner to file objections to the impugned notice within a period of one week from today, which shall be considered by the respondent authorities and it is only thereafter, if the respondents are not satisfied with the explanation submitted by the petitioner and if they find there is a violation as alleged, respondents shall take necessary action. Till such time the entire exercise is completed, there shall not be any demolition carried out. Learned standing counsel for GHMC shall inform the respondent authorities accordingly. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the Miscellaneous Petitions, if any pending, shall stand closed.
