THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.Nos.35175, 35183, 35188, 35194 & 35207 OF 2015 COMMON ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

Since the issue in these Writ Petitions is one and the same, they are being disposed of by this common order. The eviction notice is questioned in all these Writ Petition primarily on the ground that there was no prior notice to the petitioners and no opportunity was given to them to submit their explanation. These Writ Petitions are similar to the one considered by this Court in W.P.No.33628 of 2015, dated 12.10.2015. In view of the same, following the aforesaid judgment, these Writ Petitions are also allowed and the impugned notices are set aside. The competent authority shall, however, be at liberty to follow due process of law, if any action is intended to be taken against the petitioners. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in these Writ Petitions shall stand closed.
