THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.35257 of 2018 ORDER:

When the matter is taken up, written instructions dated 28.09.2018 furnished by the Sub-Inspector of Police, Amberpet Police Station are placed on record by the learned Government Pleader for Home.

To the extent of their relevance to the present writ petition, the said instructions read as under:

"One Sri S.Dhanunjaya, son of Sri Sunki Laxminarayana/3rd respondent herein has approached the Police of Amberpet Police Station, Hyderabad City and lodged a complaint on 20.9.2018 stating that the inmates in his house are vacating his house due to road widening except hair cutting show owner and hence he requested him politely to vacate the shop but he paid deaf ear as the GHMC authorities issued notice to him for laying of fly over bridge and the said fact of information of GHMC authorities to the hair cutting shop owner/the writ petitioner herein, he stated that he has not interested in vacating the shop and do whatever he likes and abused him in filthy language and hence requested the police to take necessary action as per law.

Upon receipt of the said petition, immediately, an entry was made into the Station General Diary on 20.9.2018, after enquiry action necessary action will be taken. To know the veracity in the contents of the petition, this respondent police summoned the petitioner and got the matter thoroughly enquired both the parties and immediately, then and there advised the complainant to seek his redressal in a competent court of law, as the dispute if purely civil in nature. Except advising the complainant to seek his redressal in a competent court of law, after enquiring the petition with the petitioner herein, this respondent never interfered with the civil disputes nor supported the 3rd respondent herein as alleged.

It is submitted that at any point of time, this respondent never threatened the petitioner or ask the petitioner to settle the matter with the complainant as alleged.

It is pertinent to submit that as a precautionary measure to prevent the police from taking any action in the event of registration of any crime against him in future, the petitioner without any basis or iota of evidence, rushed to this Hon'ble Court and filed the present writ petition with false and untenable allegations."

On noticing the above instructions, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.

Accordingly, the writ petition is disposed of by placing on record the written instructions dated 27.09.2018 furnished by the Sub-Inspector of Police, Amberpet Police Station. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
