HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.1387 of 2011 ORDER:

This Criminal Petition is filed Under Section 482 Cr.P.C. by the Petitioner-A1 to quash the proceedings initiated against her in Crime No.320 of 2010 of Suryapet Town Police Station, Nalgonda District, registered for the offences punishable under Sections 193, 209, 406, 418, 420 I.P.C. A private complaint was filed by the 1st respondent herein against the petitioner-A1 and another for the aforesaid offences before the Judicial Magistrate of First Class, Suryapet and it was referred to the police under Section 156

(3) Cr.P.C. for investigation and report. Thereafter, the Sub Inspector of Police, Suryapet Town Police Station registered the complaint as a case in Crime No.320 of 2010 against the accused for the aforesaid offences and took up investigation.

Heard the learned Counsel appearing for the petitioner, learned Counsel appearing for the 1st respondent and the learned Public Prosecutor, representing the State. The allegations in the complaint prima facie reveal the commission of alleged offences by the petitioner herein and another accused. The matter has to be investigated by the police so that the truth or otherwise of the allegations can be brought out. Therefore, I see no grounds to interfere with the investigation of the case at this stage.

Accordingly, the Criminal Petition is dismissed. However, the Investigating Officer is directed to proceed with the investigation expeditiously, without arresting the petitioner-A1 till filing of the charge sheet in the case. Miscellaneous petitions, if any, pending shall stand closed.
