This petition is filed to withdraw FC.OP.No.607 of 2014 from Additional Family Court, Visakhapatnam and transfer the same to III Additional Senior Civil Judge, Kakinada, East Godavari District.

Wife filed this application and according to her affidavit, her marriage was performed with the respondent on 15.08.2009 and out of the wedlock a male child was born in the year 2011 and due to harassment in the hands of respondent she is now staying at her parents house with her minor child. It is stated that respondent filed the above O.P. for dissolution of marriage and it is difficult for her to attend Additional Family Court, Visakhapatnam, which is about 200 kms away from Kakinada as she has to look after her child who is of tender age. It is further contended that it would be convenient for her if the FCOP No.607 of 2014 is transferred from Visakhapatnam to Kakinada. For these reasons, she prayed for transfer of said O.P. to Kakinada. Respondent has not filed any counter disputing the affidavit averments of the petitioner.

Heard arguments.

Advocate for petitioner submitted that by taking the convenience of wife into consideration, O.P. may be transferred from Visakhapatnam to Kakinada. It is further submitted that III Additional Senior Civil Judge is designated for matrimonial matters and therefore the O.P. may be transferred to III Additional Senior Civil Judge, Kakinada.

Considering the reasons stated in the affidavit and also considering the convenience of wife, FCOP.No.607 of 2014 is withdrawn from Additional Family Court, Visakhapatnam and transferred to III Additional Senior Civil Judge, Kakinada, East Godavari District, for disposal in accordance with law.
