ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 to A5 seeking to quash the proceedings in Cr.No.311 of 2016 of Sanjeevareddy Nagar Police Station, Hyderabad City, registered for the offence punishable under Section 3(1)(x) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, against them.

2. Heard learned counsel for the petitioners/A1 to A5 and learned Additional Public Prosecutor representing the State.

It is alleged in the complaint that the sister of de facto complainant married one Sriram Goud by inter caste and was staying at upstairs of the house situated at Vinayakrao Nagar. 01.05.2016, after hearing noise from her sister's room, the de facto complainant came from outside the room and noticed gathering of public in front of her sister's house, in the meantime, all the accused were getting down from upstairs and abused her sister's son Mr. Srikanth in filthy language in the name of his caste and when the de facto complainant questioned, all the accused abused her in filthy language in the name of her caste.

4. As seen from the complaint, there are certain allegations against the petitioners. Truth or otherwise of the allegations made in the complaint can be ascertained by the investigating agency during the course of investigation. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, the police concerned are directed to proceed with the investigation without

arresting the petitioners/A1 to A5. The petitioners/A1 to A5 are directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

5. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
