THE HON'BLE SRI JUSTICE DILIP B. BHOSALE CIVIL REVISION PETITION No.3920 OF 2014 P.C:

Heard learned counsel for the parties.

This Civil Revision Petition impugnes the order, dated 09.10.2014, passed by the Court below in I.A.No.2096 of 2014 in O.S.No.830 of 2014.

The order of suspension, dated 29.09.2014, issued by respondent No.1 - Indian Medical Association, was suspended by order dated 09.10.2014. Respondents 1 to 3 were suspended by order, dated 29.09.2014. It is not in dispute that the order, dated 09.10.2014, operates till today. In other words, the order, dated 29.09.2014, whereby the Indian Medical Association had suspended respondents 1 to 3 does not operate as of today. In this view of the matter, learned counsel for the parties have agreed for the following order:

i) The order, dated 09.10.2014, impugned in the present Civil Revision Petition shall remain operative till the disposal of I.A.No.2096 of 2014.

ii) The Court below shall hear and decide the interim application, as expeditiously as possible preferably within six weeks from the date of receipt of this order.

iii) It is open for the parties to produce copy of this order before the Court below within a period of one week from today.

iv) It is made clear that this Court has not examined merits of the case.

v) I hope and trust that the Court below shall decide I.A.No.2096 of 2014 on merits in accordance with law and uninfluenced by the order, dated 09.10.2014, and this order.

vi) All contentions of the parties on merits are left open.

The Civil Revision Petition is accordingly disposed of. In view of the disposal of the Civil Revision Petition, nothing survives in the Miscellaneous Petitions and they are disposed of as such.
