THE HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CMP.No.819 of 2014 ORDER:
This petition is filed to withdraw Divorce O.P.No.1002/2014 from Principal District Judge, Guntur and transfer the same to any competent Court in Ranga Reddy District.

Petitioner is wife and according to her affidavit, her marriage was performed as per Christian Rites and due to harassment, she is staying separately with her parents. She stated that she gave birth to a female child aged about 11 months and that she received notice from Gutnur Court on 23-12-2014 and she is finding it difficult to attend that Court with small female baby covering at a distance of 500 Kms. She further contended that she apprehends danger to her and her children at Gutnur. For these reasons, she prayed for transfer of O.P.

Husband disputed the affidavit averments of the petitioner and filed his counter affidavit. He contended that there are no valid grounds for transfer. He further contended that he has life threat in the hands of the petitioner at Ranga Reddy and the application for transfer is not maintainable.
4. Heard both sides.
5. Both sides Advocates submitted that their arguments supporting the contentions of their respective clients. I have perused the material papers including the affidavit of the petitioner and counter affidavit of the respondent.
6. Considering the contentions and rival contentions of both parties and convenience of the wife, I feel that this petition can be considered of by directing the trial Court to dispense with the presence of the respondent herein i.e., husband for each and every adjournment.

Accordingly, petition is allowed and Divorce O.P.No.1002/2014 is withdrawn from Principal District Judge, Gutnur and transferred to Family Court, Ranga Reddy for disposal in accordance with law. Judge, Family Court, Ranga Reddy shall dispense with the presence of respondent herein for each and every adjournment. However, he shall appear as and when his physical presence is necessary for any specific purpose.
