HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.5358 of 2017 O R D E R:

The writ petition is filed challenging the action of the respondents 4 and 5 in interfering with the civil disputes between petitioner and the 6th respondent and directing the petitioner to attend the police stations.

2. A counter-affidavit has been filed by respondents 1 to 5, stating that earlier a case in Cr.No.109 of 2015 was registered on 11.08.2015 by the 5th respondent against the petitioner and others, basing on the complaint of the 6th respondent, for the offence punishable under Section 498-A of IPC. However, the matter was compromised before the Lok Adalath on 11.06.2016. Thereafter, the 6th respondent filed a private complaint before the I Additional Junior Civil Judge, Sattenapalli, against the petitioner and the same was referred to the police for investigation. Accordingly, Cr.No.12 of 2017 was registered on 03.02.2017 and the investigation is under progress. After registration of the said crime, the 5th respondent, through the 4th respondent informed the petitioner about the registration of the crime. Thereafter, the present writ petition was filed. It is further stated that they never interfered with the civil disputes between the petitioner and the 6th respondent nor harassed the petitioner as alleged by him.

3. In view of the submissions made by the police in the counteraffidavit, no further orders are necessary in the present writ petition. However, the police shall investigate Cr.No.12 of 2017 only in accordance with law.

4. The writ petition is accordingly disposed of. No order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
