THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17174 OF 2017 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare the seizure of petitioner's vehicle bearing No.AR01/ G-4143 seized under vehicle report No.263375, dated 15.05.2017, by the 3rd respondent, as illegal and arbitrary.

The case of the petitioner is that his vehicle bearing No.AR01/ G4143 was seized by the 3rd respondent on 15.05.2017 while it was proceeding to Karimnagar as per the contract, under Vehicle Check Report No.263375, on the ground that they found certain irregularities at the time of check. The petitioner approached the 2nd respondent for release of the vehicle, but the 2nd respondent did not entertain the application of the petitioner. Hence, this writ petition. When the matter is taken up for hearing, learned counsel for the petitioner submitted that in pursuance of interim order, dated 18.05.2017, passed by this Court, the vehicle was released and therefore, nothing survives for adjudication in the matter. In view of the interim order, dated 18.05.2017, passed by this Court, the writ petition is disposed of. However, as far as the enquiry proposed to be conducted by the respondents, they shall proceed with the same in accordance with law. No order as to costs.
