HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5063 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/ accused No.1 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.104 of 2015 of PS Ibrahimpatnam, Vijayawada City registered for the offences punishable under Sections 420, 506, 509, 406 and 120 (B) IPC and Section 5 of A.P. Protection of Depositors of Financial Establishments Act, 1999.

2) Heard learned counsel for the petitioner/ accused No.1 and learned public prosecutor for 1st respondent-state before admission and before ordering any notice to de facto complainant-2nd respondent. Perused the material on record.

3) As the material falls short for this Court to admit the application under Section 482 Cr.P.C to quash the FIR proceedings so far as the 1st accused concerned, the same is disposed of, giving liberty to petitioner/ accused No.1 to surrender himself before the Learned Magistrate concerned and move for regular bail with notice to learned Assistant Public Prosecutor concerned and in such an event, the learned Magistrate shall grant bail preferably on the same day if not at least by next day with necessary conditions, as this Court has already ordered to accused No.3 in Crl.P.No.3744 of 2015 dated 01.06.2015.
