THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13833 of 2015 ORDER:

This Criminal Petition is filed by the petitioner - accused under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.192 of 2015 of II Town Police Station, Chittoor, Chittoor District, for the offences punishable under Sections 3, (1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and 384, 323, 341 and 506 IPC.

Heard and perused the material available on record. The allegation against the petitioner is that the de facto complainant borrowed some amount from the petitioner on interest basis and paid the instalments regularly for some time and thereafter, failed to repay the same and hence, the petitioner enhanced the loan and he is harassing and threatening the de facto complainant with dire consequence.

Learned counsel for the petitioner fairly informed this Court that the petitioner has already approached this Court by invoking the provisions under Section 482 Cr.P.C., wherein the respondent-police are directed not to arrest the petitioner till completion of investigation. The learned counsel further submitted that the investigation is completed and charge sheet is yet to be filed and hence, the petitioner is apprehending arrest in the hands of police. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

The petitioner is directed to surrender before the Magistrate concerned, if charge sheet is filed, and on such surrender, the petitioner shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety

for the like sum to the satisfaction of the Magistrate concerned. Accordingly, the Criminal Petition is disposed of. ______________ RAJA ELANGO, J January 04, 2015.
