HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.17337 of 2017 ORDER:

Heard Mr.P.Nagendra Reddy for petitioners and the learned Assistant Government Pleader for Revenue.

The petitioners pray for the following relief :- " ..... to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the respondent No 1 in trying to dispossess the petitioners from their house plot Nos.33, 7, 17 and 6 respectively situated in Sy.No.44/ IA of Pochavaram Village, Vatsvai Mandal, Krishna District by using police force without following due process of law as arbitrary illegal and consequently direct the respondent No 1 not to dispossess the petitioners from their respective house plots without following due process of law....." .

The Assistant Government Pleader disputes petitioners' possession and enjoyment of plots, referred to above. Mr.Nagendra Reddy does not wish to join issue on the statement of the Assistant Government Pleader, but submits that the petitioners are eligible for assignment and they may be given liberty to apply to respondents 1 and 2.

By granting liberty to petitioners to apply for allotment of house plots, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Date:01-05-2018 Prv
