THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.37840 OF 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner made an application under Form VI-A of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act') for mutation of her name in the revenue records. On the said application, the Tahsildar, Serilingampalli Mandal, Ranga Reddy District, the 4th respondent, called for objections by issuing notice under Form VIII of the Act in File No.B/194/2015, dated 11.04.2015, and fixed the date of hearing as 26.04.2015. The petitioner states that thereafter he did not have any notice as to whether any objections are filed and, if so, the nature of objections are not know to him. Therefore, he could not apprise the 4th respondent about third party objections, if any. It is also stated that the Revenue Inspector has already submitted a report recommending the case of the petitioner. Aggrieved by the inaction on the part of the 4th respondent, the present Writ Petition is filed.
Learned Government Pleader for Revenue has received instructions and now he confirms the pendency of the petitioner's application and states that the 4th respondent would issue notice to the parties concerned and pass appropriate orders on her application expeditiously.
In view of the same, the Writ Petition is disposed of directing the 4th respondent to fix a date of hearing, hear the parties, including the petitioner and the third party objector, if any, and take appropriate decision expeditiously, preferably within a period of six weeks from the date of receipt of a copy of this order. There
shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
