THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.7066 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India challenging the action of the 2nd respondent in not releasing the vehicle bearing No. AP 29 TB 4051, which was seized in connection with Cr.No.108 of 2013 of Vangoor Police Station, Vangoor, Mahabubnagar District. 2.

This Court, vide order, dated 17-08-2016 directed the respondents to release the subject vehicle to the petitioner who has financed its purchase to its owner on condition of petitioner producing the said vehicle as and when required for the purpose of investigation by the 2nd respondent.

Now, the learned Government Pleader on the basis of instructions submits that the sole accused in the crime died and proceedings against him abated.

In the circumstances, the petitioner can approach the 2nd respondent and take delivery of vehicle if the same is not produced before the competent Court. If the vehicle is produced before the competent Court, the petitioner shall take appropriate steps for release of the vehicle.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
