THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.20946 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents 4 and 5 in not investigating the matter in proper and perspective way in respect of Crime Nos.87 of 2015 on the file of Narsapuram Town P.S., and Crime No.70 of 2015, on the file of Narsapuram Rural P.S., as illegal, arbitrary and violation of principles of natural justice and contrary to law and legislation contemplated under Taw and consequently direct the 2nd respondent to refer the matter to the C.I.D., or any other agency none other than the respondents 4 and 5 to investigate the matters in respect of Crime Nos.87 of 2015 on the file of Narsapuram Town P.S., and Crime No.70 of 2015, on the file of Narsapuram Rural P.S.."

Heard Sri K.V.L. Narasimha Rao, learned counsel for the petitioners and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.

Today, when the matter is called, learned Government Pleader for Home has placed on record the order bearing No.651/SDPO.N/15, dated 04-08-2015 passed by the SubDivisional Police Officer, Narasapur and the said order reads as under:

"The above reference cases are case and counter. The investigation in both the cases entrusted to Inspector of Police, Narasapur for conducting of fair investigation. The Inspector of Police, Narasapur is instructed to conduct fair and \impartial investigation without any delay and complete investigation in both the cases as per merits. He is further instructed to inform the progress of the cases by time to time.

The S.I.of Police, Narasapur Rural PS is instructed to

hand over the CD files with update CDs to Inspector of Police, Narasapur immediately for continue further investigation and intimate to this office."

On noticing the same, learned counsel for the petitioners has requested this Court to record the said order and close the writ petition.

In view of the above, the writ petition stands disposed of, by recording the contents of the said order, dated 04-08-2015 passed by the Sub-Divisional Police Officer, Narasapur.
