The petition coming on for hearing upon perusing the Petition and the memo of grounds filed herein, and upon hearing the arguments of M/s Bharadwaj Associates, Advocate for the Petitioners, and of Public Prosecutor (TG) for Respondent, the Court made the following.
ORDER
THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.4497 of 2015 ORDER:
This is a petition seeking bail to the petitioners-A-1 to A-4 in the event of their arrest in Crime No.101 of 2015 registered for the offences punishable under Sections 323, 354 read with 34 of I.P.C on the file of Raidurgam Police Station, Cyberabad. Heard both sides. Perused the material on record. The case of the prosecution, in brief, is that on 13.04.2015 the de facto complainant lodged a report alleging that on 12.04.2015 at about 7.00 p.m., the petitioners/A-1 to A-4 unnecessarily beat and kicked him and that when one Shyamala tried to stop the quarrel, the petitioners also beat her and tore her blouse and outraged her modesty. Basing on the said complaint, the above case is registered.
Learned Counsel appearing for the petitioners contended that the petitioners are innocent, that a false case has been foisted against them, that they are being subjected to unnecessary harassment in view of the pendency of the crime and they are apprehending arrest at the hands of the police under the influence of the complainant. The petitioners are said to be permanent residents of Cyberabad. The record discloses that the investigation is in progress and the statements of the material witnesses have been recorded.

In the result, the petition is allowed and the petitionersaccused Nos.1 to 4 are directed to surrender themselves before the XXIII Metropolitan Magistrate, Rajendranagar, Cyberabad, within (15) days from today. On such surrender, the learned Magistrate shall release the petitioners-accused Nos.1 to 4 on bail on their furnishing personal bond for a sum of Rs.25,000/- each together with two sureties each for a like sum each to the satisfaction of the said Court, and shall further undertake not to interfere with the investigation, shall not leave the country without the permission of the Court, shall cooperate with the investigating agency and appear before them as and when directed.
