HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.80 of 2017 ORDER :

The Criminal Revision Case is filed against the docket order dated 24.09.2014 in Crl.MP.No.241 of 2014 in un-numbered Crl.R.P. of 2014 passed by the Principal Sessions Judge, Khammam.

In the course of hearing from the submissions of both sides on the maintainability of the revision, as it is the submission that the matter before the lower Court requires to be decided on merits, the revision is allowed setting aside the impugned order of the lower Court dated 24.09.2014 , since costs of Rs.200/ - (Rupees Two hundred only) is paid to the counsel for the respondents 1 to 4 in the open Court to comply with the order, resulting for non-compliance ended in dismissal as impugned, the matter is remitted back to the lower Court to decide the un-numbered Criminal Revision Petition before the Court of Sessions to decide on own merits, within three months from the date of receipt of copy of this order.
