THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14969 OF 2013 ORDER:

This writ petition is filed challenging the proceedings dated 06.05.2013 in Rc.No.A4/34790/2011 issued by the 1st respondent appointing the respondents 3 to 7 as NonHereditary Trustees to Sri Kovvuri Basivi Reddy Choultry, Samalkota (T&M), East Godavari District for a period of two years on the ground that the petitioner and his family members were declared as founder trustees to the said Choultry by virtue of Order dated 28.02.2011 in OA.No.2493 of 2010.

Learned counsel for the petitioner submits that when the earlier notification dated 26.10.2011 was issued, petitioner filed WP.No.8776 of 2012 which was disposed of by giving directions to draw up necessary schedule for rotation amongst various members of the founders family as one of the trustees of the institute. But, without doing the same, present impugned notification is issued.

Learned Assistant Government Pleader for Endowments submits that the cause in the writ petition does not survive and the matter has become infructuous.

This Court on 22.05.2013 granted interim order suspending the impugned proceedings dated 06.05.2013 for a period of four weeks to enable the respondents to draw up schedule as directed by this Court through orders in WP.No.8776 of 2012, subject to the condition that the persons nominated through the impugned orders have not assumed charge by that time.

It is to be seen that the impugned notification was issued appointing the respondents 3 to 7 as Non-Hereditary Trustees for a period of two years and the said period already elapsed and as such the cause in the writ petition does not survive. More so, as the relief sought in the writ petition is already worked out by virtue of interim order, I deem it appropriate to dispose of the writ petition in terms of the interim order dated 22.05.2013.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 19.10.2016 t k.
