THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.34492 of 2014 ORDER:
This writ petition was filed aggrieved by the alleged inaction on the part of the police authorities in investigating Crime No.3 of 2014 on the file of II Town Police Station, Kadapa.
The Sub-Inspector of Police, II Town Police Station, Y.S.R. District, Kadapa, filed a counter-affidavit stating that upon due investigation in Crime No.3 of 2014 which was registered under Sections 447 and 506 I.P.C. on the file of II Town Police Station, Kadapa, the police authorities found that no offence was made out under Section 447 I.P.C., but laid a charge sheet on 19.10.2015 insofar as the offence under Section 506 I.P.C. read with Section 34 I.P.C. was concerned and the same was taken on record by the learned Additional Judicial First Class Magistrate, Kadapa, in C.C.No.865 of 2015.
In the light of the aforestated developments, the grievance of the petitioner stands settled.
The writ petition is accordingly closed. It is however left open to the petitioner to take recourse to appropriate remedies in accordance with law, if he is aggrieved by the deletion of Section 447 I.P.C. from the charge sheet. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
