THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.2740 OF 2015 ORDER:

Heard the learned counsel for petitioners and the learned counsel for respondents.

2. This Civil Revision Petition is filed by the defendants in O.S.No.38 of 2015 on the file of the Court of Senior Civil Judge, Shadnagar (for short, trial Court).

3. There are disputes between the petitioners and the respondents with regard to land of an extent of Ac.9-09 guntas in survey No.13 of Rangasamudram Village, Farooqnagar Mandal, Mahabubnagar District. Challenging the orders of the statutory authorities under the provisions of the Andhra Pradesh (Telangana Area) Tenancy and Agricultural Lands Act, 1950, the parties filed separate Civil Revision Petitions. Thereafter, O.S.No.38 of 2015 (which was initially numbered as O.S.No.6 of 2014 on the file of the Court of Principal Senior Civil Judge) was filed by the respondents, pending on the file of the Court of Senior Civil Judge, Shadnagar against the petitioners herein. Challenging the institution of suit, the present revision is filed.

4. If there is any grievance for the petitioners, they have to take appropriate proceedings before the Court, where the suit is pending. Now the learned counsel for the petitioners submits that he filed a petition in the above suit seeking rejection of the plaint and the same is pending for consideration before the Court of Senior Civil Judge, Shadnagar.

5. In view of the same, the present Civil Revision Petition is not maintainable and it is accordingly dismissed at the admission stage. It is open to the petitioners to take appropriate proceedings in the pending application seeking

rejection of the plaint. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
