HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.42948 OF 2016 ORDER:
The case of the petitioner is that she is the owner and possessor of land admeasuring Ac.4.00 in Survey No.119/A and 119/AA situated at Jannaram Village, Enkoor Mandal, Khammam District which was given to the petitioner to her share in the form of 'pasupukumkuma' and pattadar pass book also issued to her and the old revenue records clearly show her name as possessor. When she came to know that unofficial respondents' names were incorporated in the revenue records in respect of the subject land, she made representation dated 08.02.2016 before the 4th respondent. As no action is being taken, petitioner made another representation dated 21.03.2016 vide complaint No.PP210316-62286 before the 2nd respondent and the same was referred to 4th respondent for enquiry. As no action is being taken on the same, present writ petition is filed. Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Revenue as well as learned counsel appearing for respondents 5 and 6 submits that regarding alteration of revenue records beyond one year the 4th respondent has no jurisdiction to entertain the same and that on mere representation the entries which were in existence since long time cannot be changed. They
further submits that the petitioner has to approach the 2nd respondent by filing a revision.
Though learned counsel for the petitioner made representation before the 2nd respondent regarding change of revenue records, on the mere representation, the 2nd respondent cannot grant relief. As such, no relief can be granted. In view of the same, it is open for the petitioner to file appropriate application under Section 9 of the A.P.Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act') or to avail alternative remedy under Section 8(2) of the Act. Subject to above observation, the writ petition is dismissed. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 18.01.2017 t k.
