THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY WRIT PETITION NO.40839 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondent Nos.2 to 5 in not preventing the sixth respondent from making constructions in the bus shelter, in an extent of four (4) ankanams in survey No.311 of Turpupundla Village, Saidapuram Mandal, SPSR Nellore District, as illegal and arbitrary.

Heard the learned counsel for the petitioner, learned Government Pleader for Panchayat Raj, representing respondent Nos.1 and 2, learned Standing Counsel for Panchayat Raj representing respondent No.3, learned Standing Counsel for APSRTC representing respondent No.4 and learned Government Pleader for Home representing respondent No.5. 3.

It is the case of the petitioner that one Duttaluru Siddaiah Naidu donated an extent of four (4) ankanams in survey No.311 of Turpupundla Village, Saidapuram Mandal, SPSR Nellore District, for construction of bus shelter. It is the further case of the petitioner that sixth respondent encroached the said site and making constructions without obtaining necessary permission from the Gram Panchayat. Learned Standing Counsel for APSRTC submitted that the land in question does not belong to APSRTC. 4.

A perusal of the record reveals that the petitioner made a representation dated 04.11.2016 to the second respondent to take appropriate action against sixth respondent. For one reason or the

other, the second respondent did not dispose of the representation of the petitioner.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the second respondent to dispose of the representation of the petitioner dated 04.11.2016. In view of the said submission, this Court is not inclined to go into merits of the main case.

Having regard to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the representation of the petitioner dated 04.11.2016, in accordance with law, as expeditiously as possible.

With the above direction, the writ petition is disposed of. Miscellaneous petitions if any pending in this writ petition shall stand closed.
