HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.198 of 2017 ORDER :

This petition is filed by the petitioner under Section 407 Cr.P.C., seeking transfer of C.C.No.88 of 2017 on the file of the II Additional Chief Metropolitan Magistrate, Vijayawada, to any competent Court in Tenali, Guntur District, which is an outcome of the private complaint of the 2nd respondent, registered for the offence punishable under Section 138 of the Negotiable Instruments Act (for short 'the Act').

Heard learned counsel for the petitioner and learned Public Prosecutor representing the State before ordering notice to the 2nd respondent.

It is stated by the learned counsel for the petitioner that the petitioner is a lady, aged about 52 years and hence seeks transfer of the said C.C. In fact, the complainant even from the very complaint and the petition cause title, aged about 70 years. Thus, there is nothing to transfer the case on that ground, but for, to say for any personal

difficulty for attending the Court, the petitioner is permitted to file an application under Section 205 Cr.P.C. before the learned Magistrate to represent through special vakalat holder and the learned Magistrate to hear and pass orders by considering the same with necessary conditions of personal appearance as and when required.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending shall stand closed.
