THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.15452 OF 2014 ORDER:

Heard both sides.

The petitioners/accused Nos.1 to 3 are being ascribed of the offences punishable under Sections 498A, 324 IPC and Sections 4 and 5 of Dowry Prohibition Act. A complaint was lodged by the wife of 1st petitioner/1st accused and the investigation in this case is stated to be pending.

A perusal of complaint allegations reveal that it is not a fit case to order quashment of the FIR. Hence, while dismissing Criminal Petition, it is ordered thus:

"The police KPHB Colony PS shall pursue investigation and complete the same at the earliest. However, they are directed not to arrest the petitioners/A1 to A3 during the course of investigation. Petitioners/A1 to A3 are directed to cooperate with the investigating agency and make themselves available to the police when required. With the above observation, the Criminal Petition is dismissed. As a sequel, Miscellaneous Petitions pending, if any, shall stand closed.
