HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.39895 of 2016 Order:
This Writ Petition is filed challenging the proceedings dated 26.10.2016 of the third respondent giving safe custody of cattle to the fourth respondent pursuant to registration of Crime No.366 of 2016 for the offences under Sections 4, 5 and 6 of the A.P. Prohibition of Cow Slaughter and Animal Preservation Act, 1977 read with Section 11(1)(A)(B)(E)(H) of the Prevention of Cruelty to Animal Act, 1960. The main grievance of the petitioners is that in spite of showing the proof of ownership of cattle, the cattle was handed over to the fourth respondent by the third respondent pursuant to registration of the crime. If that is so, it is for the competent Court to pass orders on the application of the petitioners. Since a crime was registered, this Court cannot entertain the present Writ Petition under Article 226 of the Constitution of India.
In the circumstances, the Writ Petition is dismissed giving liberty to the petitioners to avail alternative remedies available to them under law. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
