HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner alleges that respondents 5 and 6 are undertaking illegal construction and in spite of bringing to the notice of the GHMC authorities, illegal construction is not stopped. 2.

Learned standing counsel, on instructions, submits that house number mentioned by the petitioner with reference to the illegal construction undertaken by the respondents 5 and 6 could not be located. He would submit that in slum areas, it is difficult to locate the house numbers. If the petitioner furnishes the correct particulars, appropriate action will be initiated. 3.

Learned counsel for petitioner submits that petitioner would make a representation to the Assistant City Planner with all details of the property in which the alleged illegal construction is being undertaken.

Taking note of the above submissions, writ petition is disposed of, granting liberty to the petitioner to make a representation to the Assistant City Planner (4th respondent) by giving all the particulars of the alleged illegal construction undertaken by the respondents 5 and 6 and on filing such representation, the 4th respondent shall examine the issue and if he comes to prima facie conclusion that the allegation made by the petitioner is having some basis, he shall cause show-cause notice upon the respondents 5 and 6 and after giving due opportunity, appropriate orders may be passed as warranted by law. It is made

clear that there is no express of opinion on merits and the rights and defense of the respondents 5 and 6 are preserved. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO kkm
