HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 16190 of 2016 ORDER:

Vide the present petition, the petitioner/A.1 seeks a direction thereby to release him on bail pending trial in SC.No.109 of 2015 on the file of learned First Additional Sessions Judge, Ananthapuram, which arose out of Cr.No.104 of 2014 of Narpala PS, Ananthapuram District.

Learned Additional Public Prosecutor appearing on behalf of the State has strongly opposed the present petition and submits that the petitioner is a habitual offender, that 18 cases were registered against him; whereas learned Counsel for the petitioner submits that total six cases were registered against him, however, the petitioner was acquitted in SC.Nos. 76 and 79 of 2014 on 7.12.2015; in SC.No.46 of 2014 on 17.09.2016 and in SC.No.45 of 2014 on 17.10.2016.

On 18.11.2016 learned Counsel appearing on behalf of the petitioner sought time to obtain instructions from his client regarding registration of eighteen cases against him as contended by learned Additional Public Prosecutor.

To day, the learned Counsel appearing on behalf of the petitioner submits that he has verified the same with his client and concedes with the submission of learned Additional Public

Prosecutor that there are eighteen cases registered against the petitioner, however, in five cases, the petitioner has been acquitted, in one case he has been convicted and sentenced to undergo simple imprisonment for ten months and the rest of cases are pending trial.

Keeping in view the fact that the petitioner is a habitual offender, I am not inclined to grant bail.

The Criminal Petition is dismissed.
