HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.12716 OF 2015 ORDER:
Challenging the action of the 2nd respondent-Tahsildar in rejecting the application of the petitioner dated 16.01.2015, for issuance of Backward Class-A (Agnikula Kshatriya) caste certificate, through the endorsement dated 25.02.2015, the writ petition is filed.
Heard Sri V. Eswaraiah Chowdary, learned counsel for the petitioner and the learned Assistant Government Pleader for Social Welfare. Learned counsel appearing for the petitioner submits that the endorsement dated 25.02.2015 of the 2nd respondent-Tahsildar, is absolutely a non-speaking order and nothing is discernable from the said order as to why the caste certificate has been rejected and thereby even the appeal provision also does not help the petitioner in any way.
It is very unfortunate that the endorsement made by the 2nd respondentTahsildar rejecting the application of the petitioner using only one word "rejected". Under what circumstances the caste certificate of the petitioner is rejected, is not discernable. Further, the same authority infact had issued caste certificate to the petitioner on 02.07.1991 showing her as Back Ward Caste community. Even the certificate issued in favour of the father of the petitioner also shows that he belongs to Back Ward Caste community. In those circumstances, the endorsement dated 25.02.2015 of the 2nd respondent-Tahsildar is set aside with a direction to the respondents to consider the application of the petitioner along with the material on record and pass appropriate orders within a period of two weeks from today. With the above observations, the writ petition is disposed of. Miscellaneous Petitions, if any pending in this writ petition shall stand closed. No order as to costs.
