This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/accused Nos.1 to 42 seeking to quash the P.R.C. No.73 of 2013 on the file of the Judicial First Class Magistrate, Adoni, for the offences under Sections 147, 148, 332, 353, 307, 448 and 452 read with Section 149 I.P.C.
Heard the learned counsel for the petitioners/accused Nos.1 to 42 and the learned Public Prosecutor and perused the material available on record. On a perusal of the record, this Court is of the view that truth or otherwise of the allegations made against the petitioners can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against the petitioners. However, the learned trial Court is directed to see that P.R.C. is committed to the Court of Sessions as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of the order by taking all coercive steps as are permissible under law.
