THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20224 of 2016 ORDER:
Heard learned counsel appearing for both parties. With the consent of counsel appearing for both sides, the present Writ Petition is disposed of at the admission stage.
2. The present Writ Petition came to be filed with the following prayer: "issue an appropriate Writ order, or direction more particularly in the nature of Writ of mandamus and declaring the action of the respondent 2 are highly illegal, arbitrary, contrary to law and clear violation of Articles 14, 21 Constitution of India and principles of natural Justice and consequently to direct the respondent 2 herein to mutate the petitioner's name instead the name of late Pasal Arogyam in the Municipal record in respect of the subject land situated in Nandigama Town, Krishna District."
3. The grievance of the petitioner is that her maternal grandfather by name late Pasala Arogyam is having a house property situated in Nandigama Town, Krishna District and during his life time he paid necessary taxes to all concerned departments. The mother of the petitioner and other family members are residing in the house bearing D.No.104 along with Pasala Arogyam. After death of Pasala Arogyam, the petitioner vacated the premises and made a representation on 01.02.2016 to the 2nd respondent for mutation of her name in the revenue records. In the month of April, 2016 the petitioner also approached the 2nd respondent for mutation of her name in the revenue records. But, till today the 2nd respondent did not pass any orders on the said representation and hence seeks disposal of the said representation.
4. Having regard to the above and without going into the merits of the case, the Writ Petition is disposed of directing the 2nd respondent to pass appropriate orders on the representation, dated 01.02.2016, said to have been submitted by the petitioner, in accordance with law, at the earliest, if the same is still pending consideration.
